The Immigration and Nationality Act (INA) breaks visas for family members into two categories – “immediate relative” and “family preference”. The “immediate relative” category includes a U.S. citizen’s parents, spouse, and children who are under 21 years and unmarried. The “family preference” category has four sub-categories:

First preference: Adult (21 years old or older) children of U.S. citizens who are unmarried.

Second preference: a legal permanent resident’s spouse, and unmarried sons and daughters and their children.

Third preference: a U.S. citizen’s married sons and daughters, their spouses and minor children.

Fourth preference: a U.S. citizen’s brothers and sisters, their spouses and their minor children.

While the U.S. doesn’t limit the number of immediate relative visas, the demand for “family preference” visas usually exceed the limited number of visas available.
